At a tense Senate Homeland Security and Governmental Affairs Committee hearing on the COVID‑19 pandemic surrounding Dr. Fauci, Sen. Rand Paul clashed with Sen. Richard Blumenthal after ordering Dr. Anthony Fauci’s attorney removed from the room. Dr. Fauci, appearing under subpoena, repeatedly invoked his Fifth Amendment right against so-called self‑incrimination and declined to answer questions about his pandemic‑era decisions, citing Paul’s past public calls for his prosecution as the reason for his fear of legal exposure.
Fauci’s lawyer, David Schertler, attempted several times to address the committee from the witness table despite being told he was not recognized and had not been invited to testify or even sit at the same table as Fauci. Paul warned Schertler to “sit quietly” and reminded him that in a courtroom a judge could jail someone for such behavior, before ultimately directing security to escort the attorney out as cameras and broadcast feeds captured the confrontation.
After Schertler’s removal, Blumenthal, a Democratic senator from Connecticut, condemned the proceedings as a “short‑sighted act of desperation” and said they resembled a vendetta against a single individual rather than a good‑faith search for information. Blumenthal read from Fauci’s attorney’s letter describing Paul’s “years‑long public crusade” and warning that tweets about “putting Fauci in jail” created a well‑founded fear of prosecution, arguing that this context justified Fauci’s choice to plead the Fifth.
Paul responded by “schooling” Blumenthal, as the internet later described it, insisting that “the Fifth Amendment doesn’t work that way” because a witness cannot refuse to testify and then have their lawyer effectively testify in their place. Reasserting his authority as chair, Paul said Schertler “was out of order” and that ejecting him was appropriate, while vowing to move forward with a contempt vote for Fauci over his blanket refusal to answer the committee’s questions.
