Ex-CIA officer caught with $40mn in gold bars seeks plea deal

The potential agreement could avert a public trial and keep “classified material” under wraps

The US Justice Department has reached a tentative plea agreement with an ex-intelligence officer suspected of faking a classified CIA assignment to steal more than $40 million in government-provided gold bars as “work-related expenses.”

David Rush, a former senior CIA official with top-secret clearance, was arrested in May after an internal probe discovered he had lied about his education and Navy service. A search of his Virginia home uncovered a trove of 303 one-kilogram gold bars, some $2 million in cash and 35 luxury watches.

Rush has so far been formally charged only with theft of public funds for falsifying pay records to obtain around $77,000 in military-leave compensation. The case has not yet been presented to a federal grand jury.


In a joint motion filed on Friday, Rush and federal prosecutors said they had reached a “plea agreement in principle” and asked the court to extend the indictment deadline from September 17 to October 8, giving them another 21 days to resolve the matter.

“The parties need additional time to prepare the paperwork,” Assistant US Attorney Raizza Ty and Rush’s attorney, Jessica Carmichael, wrote in the filing. “A pre-indictment resolution promotes the public interest by conserving government and judicial resources.”

The document did not disclose what charge Rush would plead guilty to or any possible sentencing recommendation. The parties said proceeding with an indictment and trial would require extensive litigation involving classified material. A deal could avert a public trial and keep key details of the case under wraps.

The court filings said that, beginning last November, Rush requested and received “a significant quantity of foreign currency and tens of millions of dollars in gold bars for work-related expenses,” but official details remain scarce. According to media reports, Rush invented a special-access “continuity of government” operation, ostensibly intended to preserve federal functions during a nuclear war or other catastrophe.

The case has also drawn scrutiny of US Deputy Secretary of Defense Stephen Feinberg, a private-equity billionaire who reportedly oversees the Pentagon’s $33 billion military-intelligence budget. Earlier this week, NBC News reported that Feinberg recommended Rush for sensitive assignments and praised his performance to senior CIA officials. The outlet also said footage showed both men at a government-affiliated residence used by Rush.

Feinberg has not been accused of wrongdoing, and the Pentagon has denied he endorsed Rush for any position, describing reports of a close professional relationship as “false and embellished.”
