Jay Clayton, the current U.S. Attorney for the Southern District of New York, sat for a confirmation hearing for the position of Director of National Intelligence (DNI). President Trump appointed the former SEC chair and Senior Policy Advisor for the law firm Sullivan & Cromwell to the top intelligence role.
On the eve of a public address by President Trump, speculated to be disclosing recently declassified intelligence documents suggesting foreign interference and other significant issues with the 2020 election, Democrats sought to focus on efforts to delegitimize the upcoming exposé by trying to tempt the DNI hopeful to concede that “Joe Biden won the 2020 election”.
The Gateway Pundit has written extensively about the severe election discrepancies in Fulton County, many of which were cited in the affidavit to obtain the search warrant in January 2026.
Numerous issues have been raised regarding foreign interference from countries such as China.
The Gateway Pundit has recently disclosed over 26,000 mail-in ballots in Wayne County, Michigan alone that were missing the required absentee envelope.
But Democrats took the confirmation hearing of Jay Clayton as an opportunity to try and sway public opinion before President Trump’s address tomorrow evening.
Senator Jon Ossoff (D-GA), who, along with Raphael Warnock (D-GA), was a benefactor of the 2020 election in Georgia, asked Clayton, “Who won the 2020 election?”
“I’m not gonna do this with you,” Clayton fired back.

Ossoff continued by pressing Clayton on whether or not he was aware that former DNI Tulsi Gabbard was present at the Fulton County offices when the FBI lawfully seized election documents through a court-issued search warrant.

The election questions didn’t end with Ossoff. Senator Mark Warner (D-VA) also pressed Clayton on whether or not Joe Biden won the 2020 election.
“Senator, I’m not an election denier. Joe Biden was certified as the President of the United States,” Clayton responded.
“Election denial is something we cannot have. So I will take that as you do not deny that Joe Biden won the 2020 election,” Warner stated.
“Let me just be clear: we have substantial work to do in improving our electoral processes. It’s part of national security and I feel strongly about it,” Clayton clarified.

Senator Angus King (D-ME) also pressed the DNI nominee on “election denialism.”
“Who won the 2020 election?” he asked.
“I’ve answered that question. I’m not gonna get into that…” Clayton answered before King interrupted with, “You have not answered that question. Could you answer the question? Who won the 2020 election?”
Clayton doubled down that Joe Biden was certified and “became the President of the United States.”
“I’m here to talk about my qualifications,” Clayton stated.
KING: Who won the 2020 election?
CLAYTON: I’ve answered that question. I’m going to get into that
KING: You have not answered that question. Could you answer it?
CLAYTON: Joe Biden was certified

And in the culmination of the desperate urge for Democrats to get the incoming DNI to admit that Joe Biden won the 2020 election, Senator Mark Kelly (D-AZ) tried a “gotcha” question:
“Can you tell me why Joe Biden was certified as the winner of the 2020 election?” he asked.
“I’m going back to my Constitutional law here…but he had the most electoral votes,” Clayton responded.
“So he won the election?”
“He followed our process, had the most electoral votes, was declared the winner, and…”
Kelly interrupted, “And who has the most electoral votes? Is it the person that wins or the person that loses?”
“I think that’s your characterization. I’m not going to continue to do this.”
KELLY: Can you tell me why Joe Biden was certified as the winner of the 2020 election?
CLAYTON: … I really … Uhm … I don’t want to continue to debate about this, but I believe he had the most electoral votes
KELLY: So he won the election?
