An Albuquerque man is being held without bond after police say he shot and killed his cousin following a fight over the heat of green chile enchiladas at a family dinner.

Ervin Gutierrez, 22, of Roswell, has been charged with murder for the shooting of 25-year-old Nathaniel Cavazos.

Albuquerque police say the two were drinking and eating at an apartment when an argument over how spicy the chile was turned into a physical fight.

Gutierrez had reportedly complained that his were too hot.

KOB 4 reports:

According to court documents, the argument started when Gutierrez began antagonizing Cavazos by saying the chile in his enchiladas was too hot.

Police said Serrano suggested taking the dogs on a walk to cool off, but the argument grew and Gutierrez and Cavazos started fighting.

After that fight, police say, Gutierrez pulled out a handgun and shot Cavazos several times.

Police were called to the scene late Thursday and found Cavazos on the sidewalk between the buildings and the parking lot.

Cavazos was pronounced dead at the scene.

Gutierrez had fled, but later turned himself in and was booked into the Metropolitan Detention Center.

A judge ruled Friday that Gutierrez will stay in jail as the trial proceeds.
