Former County Clerk Tina Peters smiles on her way to sentencing. The venomous judge sentenced the 69-year-old Gold Star Mother to 9 years in prison for downloading election results following the 2020 election, when the state told all clerks to delete the evidence.

Many are struggling to understand why this Gold Star Mom, Whistleblower, Cancer Survivor, and Patriot is still languishing away in a Colorado prison. If you have been following the stories about Tina, you know that she has been in a fight for her life against a biased Colorado judicial system.

On June 4th, 2025, the legal team for Tina Peters, former Mesa County Clerk, filed a response to a federal court asking to let her out of jail while she appeals her criminal conviction. In a recent court filing, Peters argues that her request is based on constitutional rights and that she has already gone through all the proper steps in Colorado’s legal system.

The federal court had questioned whether her request should be thrown out because it might include legal claims that haven’t been fully addressed by state courts. But Peters and her legal team say that’s not the case.

They explain that she’s not trying to overturn her conviction right now. Instead, she’s asking for temporary release on bail while her appeal is being considered. According to her lawyers, this is a different kind of legal request that follows different rules.

Peters says her rights under the U.S. Constitution were violated in three ways:

Free Speech: She believes her First Amendment rights were ignored.

Fair Trial: She says she wasn’t allowed to fully defend herself in court.

Federal Protection: She argues that she was acting under federal law when she preserved election records, and that should protect her from state prosecution.

Her legal team says they presented all of these arguments to the Colorado Court of Appeals when they asked for bail, and that’s all the law requires before turning to a federal court.

The federal judge will now decide whether Peters’ request can move forward. The outcome could affect how other people in similar situations seek release while their appeals are still pending.
