No charges filed against Manteca councilman who shot stepson in self-defense during attack

A Manteca City Council member who shot his stepson during a confrontation at his home last month will not be criminally charged, according to the Manteca Police Department.

The San Joaquin County District Attorney’s Office has decided not to file charges against Councilman David Breitenbucher. However, his stepson Landon White will be charged with assault with the intent to commit great bodily injury, police said in a statement released on Saturday.

The decision came after a “thorough joint investigation” conducted by the district attorney’s office and the police department, officials said.

The incident occurred at about 12:28 p.m. on Jan. 23 in Breitenbucher’s home in the 1000 block of Yolo Street.

Breitenbucher called 911 and said that his stepson had attacked him and threatened to kill him. White, 31, did not live in Breitenbucher’s home. The councilman also reported using his firearm in self-defense, police said.

Breitenbucher suffered a head injury and White was shot in the abdomen. They were both taken to a local hospital for treatment, police said.

During a news conference held on the day of the shooting, Manteca Police Chief Stephen Schluer said Breitenbucher and White had been stepfather and stepson for about six months. Schluer said White “had some difficulties with different family members” in the past, but the department hadn’t received a call for service regarding the two until the shooting.

Breitenbucher has served as the District 3 representative on the Manteca City Council for six years. He is also the city’s vice mayor.
