Just hours after the Supreme Court issued a ruling, a federal judge temporarily blocked the Trump Administration from transferring the 8 illegal aliens stuck in Djibouti to South Sudan.

Judge Randolph Moss, an Obama appointee, held an emergency hearing before a flight scheduled for 7 pm departed Djibouti to transfer the illegals to South Sudan.

Judge Moss punted the case to a district court in Massachusetts and gave the plaintiffs’ attorneys one hour to file their emergency claim.

Judge Moss in DC (Obama) formally transferred the case the case to Judge Murphy (Biden) in Massachusetts.

The Trump DOJ said they would immediately appeal to the Supreme Court.

The US Supreme Court 7-2 on Thursday granted the Trump Administration’s request to lift a Biden judge’s order blocking the deportation of the 8 illegals currently stuck in Djibouti.

Liberal Justice Elena Kagan joined the conservative justices and issued a concurring opinion.

However, liberal Justice Sonia Sotomayor fumed in her dissenting opinion. Justice Jackson joined Sotomayor.

“For all that, moreover, the majority does not actually clarify its prior decision. The majority says it expects “that the District Court will now conform its order to our previous stay,” ante, at 2, but it refuses to explain what such conformity would involve. As a result, today’s order not only excuses (once again) the Government’s undisguised con-tempt for the Judiciary; it also leaves the District Court without any guidance about how this litigation should proceed. The District Court cannot adjudicate plaintiffs’ serious due process claims on their merits without ensuring, byway of injunctive relief, its jurisdiction over the case. Yet this Court refuses to explain what injunctive relief, if any, it believes the District Court can issue,” Sotomayor wrote in her dissent.

In May, US District Judge Brian Murphy, a Biden appointee, said the Trump Administration violated his court order to provide the aliens with “meaningful” due process since they were being sent to “third-party” countries.

The US government doesn’t even have a detention facility in Djibouti, so 11 ICE agents are detaining the aliens in a conference room in a converted Conex shipping container on the US Naval base in Camp Lemonnier, Djibouti.
