AfD Ban Looms Closer as Germany’s Top Court Appoints Far-Left Globalist Activist Judge

The Alternative for Deutschland (AfD) faces a dire threat as Frauke Brosius-Gersdorf, a lawyer with far-left credentials, is set to join the Federal Constitutional Court, the nation’s highest judicial body.

Her nomination, backed by the Social Democratic Party (SPD) and, shockingly, Chancellor Friedrich Merz’s ostensibly center-right Christian Democratic Union (CDU), establishes a troubling precedent which could imperil the broader conservative cause.

Brosius-Gersdorf’s ascent to the Karlsruhe-based court, where she is a leading candidate to become president, raises alarms for defenders of free speech, religious liberty, and traditional values.

During a 2024 talk show, she championed Germany’s “defensive democracy,” advocating for mechanisms to ban “anti-constitutional” parties like the AfD, the country’s second-most popular party in February’s elections. When pressed on her comment that such a ban wouldn’t “eliminate” the AfD’s supporters, she chillingly suggested that individuals could be stripped of fundamental rights, including the ability to run for office.

The SPD, led by Vice Chancellor Lars Klingbeil, has intensified its campaign to outlaw the AfD, branding it “extremist” and unfit for parliament. A motion passed by the SPD calls for a ban if Germany’s domestic intelligence agency labels the AfD as a threat.

This push, coupled with Brosius-Gersdorf’s potential leadership of the Constitutional Court, could pave the way for the judiciary to dismantle a major political rival, a move Chancellor Merz has so far resisted as an attack on democratic competition.

Brosius-Gersdorf’s activism extends beyond party politics. In 2021, she argued that Germany’s constitution implied a mandate for compulsory COVID-19 vaccinations, asserting the state’s duty to protect the vaccinated majority from the unvaccinated. This stance, rooted in a now-discredited belief that vaccines halted transmission, indicates her willingness to prioritize state control over individual freedom.

She has also pushed for “gender-appropriate” language in the German Basic Law, claiming the traditional masculine form marginalizes women and non-binary individuals. The German language, like Spanish, relies on masculine and feminine forms. Her stance clearly undermines this linguistic and cultural heritage.

The CDU’s support for Brosius-Gersdorf, in exchange for SPD backing of their own judicial nominee, Günter Spinner, has baffled conservative voters. Protest from the SPD and Greens forced the withdrawal of a more conservative candidate, Robert Seegmüller. The CDU’s compromise risks empowering a judge whose views clash with its base.

Brosius-Gersdorf’s election requires a two-thirds majority in the Bundestag, likely securing support from the SPD, Greens, and Left MPs. Only a revolt by CDU members could derail her appointment, but party discipline makes this unlikely.

The stakes are monumental for conservatives. A Brosius-Gersdorf-led court could not only greenlight an AfD ban but also erode protections for free expression and religious liberty. As Germany’s political landscape tilts left, the judiciary’s role as a neutral arbiter hangs in the balance, threatening the democratic values that millions hold dear.
